1.- COMPANY ORGANIZING THE PROMOTION
The Company Sierra Chica Software S.L with registered office in Penelope 34 Coin (Malaga) SPAIN and identified with the number B02876803 organizes the sweepstakes (hereinafter referred to as “CycleGo Lifetime”) of international scope, to be developed through the Internet.
The purpose of this sweepstakes is to reward the loyalty of the brand’s followers.

2.-STARTING DATE AND ENDING DATE
The Promotion will begin on June 5, 2023 at 08.00 am EST, and will end on June 12, 2023 at 11:59 pm EST.
The Company reserves the right not to proceed with the promotional action if by the reflected end date of the promotion there has not been more than 50 participation. Likewise, the Company may extend the termination of the promotional action for 1 more week, being the new termination date on June 19, 2023 at 11:59 pm EST in the event that less than 50 participation is registered.

3.- PARTICIPATION REQUIREMENTS AND MECHANICS OF THE PROMOTION
The participation requirements will be the following:

– Participation will be open to those persons who are over 18 years of age with no geographical restrictions.
– Only those Participants who are holders of an Instagram account will be able to participate.
– Participants must be followers of the instagram page @CycleGo.app. This data will be checked at the time of the drawing, making a winner void if he/she does not meet this requirement.
– Participants must comment on the @CycleGo.app post associated with the sweepstakes on the Instagram social network by tagging 2 friends during the participation period.
– Participants may only participate with a single Instagram profile. If a Participant is found to participate with multiple Instagram profiles they will be disqualified.
– Even if Participants write several comments on the same post, they will only participate with a single entry in the random drawing.

4.- CONDITIONS OF THE PROMOTION AND PRIZES
The winner will be chosen randomly through the Easypromos platform. The winner will be communicated on June 13, 2023 through the brand’s social profiles, along with the certificate of validity of the sweepstakes.
The prize will consist of a free “Lifetime” subscription to our CycleGo app. This means that you will be able to enjoy the CycleGo app without restrictions for as long as the app exists and continues to provide support for a guaranteed minimum period of one year.
The prize is not redeemable for cash or any other prize, nor can it be exchanged or altered.
The winner may contact the Company within 15 days from the date on which it is announced on the brand’s social profile, to inform the Company of the user profile/email on which he/she wants the free subscription to be activated.
In the event that no such contact is made within the stipulated period, another winner will be selected [or the sweepstakes will be declared void, if no other winner is available].
The holding of the drawing, as well as the awarding of the prize are subject to the tax regulations in force.

5.- DISQUALIFICATIONS AND PENALTIES
If it becomes evident that any of the Participants does not comply with the requirements stipulated in section 3, or if the data provided to participate in invalid, their participation will be considered null and void and they will be automatically excluded from the Promotion, losing all rights to the prize awarded by virtue of this Promotion.
The Company reserves the right to declare the sweepstakes void.

6.- PUBLICATION OF COMMENTS OR OPINIONS
Comments or opinions whose content is considered inappropriate, offensive, abusive or discriminatory or that could violate the rights of third parties will not be permitted. Comments against an individual that violate the principles of the right to honor, personal and family privacy and self-image will not be permitted.
We shall not be held responsible for any harm or damages caused by the comments made by the Participants in the Promotion, which at any time could hurt the sensitivity of other Participants.
The participation in this Promotion, as well as the publication of the comments made by the Participants in the publications may not violate under any circumstances the Instagram Community Rules or the Instagram Terms of Use.
If the Company discovers the use of fraudulent means for participation, such as the use of bots in the comments, the prize will not be awarded and will remain the property of the Company.

7.-LIABILITY DISCLAIMER
By way of example, but not limited to, we are not responsible for possible losses, theft, delays or any other circumstance attributable to third parties that may affect the development of this Promotion, nor are we responsible for the use made by the Participant with respect to the prize obtained from this Promotion.
We do not assume responsibility in cases of force majeure or fortuitous event that could prevent the Promotion from being carried out or the total or partial enjoyment of the prize.
In the event that this Promotion cannot be carried out, either due to fraud detected in the same, technical errors, or any other reason that is not under the control of the Company and that affects the normal development of the Contest, we reserve the right to cancel, modify, or suspend the same, including the participation web page.

8.- PROTECTION OF PERSONAL DATA
The Company responsible for the processing of your data is Sierra Chica Software S.L., located in Penelope 34 Coin (Malaga) SPAIN and identification number B02876803.
In accordance with the provisions of the General Data Protection Regulation, each participant with the acceptance of these Legal Foundations, consents that their personal data will be incorporated into a file, with ownership of said file, in order to manage the drawing, as well as disseminate and publicize their results, and process the delivery of the prize.
Please note that you can exercise your rights of access, rectification, deletion, opposition, limitation of treatment, portability, forgetfulness and not to be subject to automated individual decisions by sending an e-mail to hello@sierrachica.com attaching a copy of a document of identification.
Without prejudice to any other administrative remedy or legal action, the Participant shall have the right to lodge a complaint with a Supervisory Authority, in particular in the Member State in which he/she has his/her habitual residence, place of work or place of the alleged infringement, in the event that he/she considers that the processing of his/her personal data is not in compliance with the regulations, as well as in the event that he/she does not see the exercise of his/her rights satisfied.
It is for this reason that the Participant declares to have been informed of the conditions regarding personal data protection by accepting and consenting to the terms.

9.- CHANGES AND ACCEPTANCE
We reserve the right to modify or extend these promotional rules, to the extent that it does not harm or undermine the rights of the Participants in the Promotion.
The mere fact of participating in the sweepstakes implies that the Participant fully accepts the conditions of these Terms and Conditions. Likewise, participation in a sweepstakes of this nature implies acceptance of the rules of the social network Instagram through which the same is developed.

10.- APPLICABLE LEGISLATION AND JURISDICTION
These legal terms shall be governed in accordance with Spanish law [country of the organizer]. The Courts and Tribunals of the Participant’s city of residence shall be competent to resolve any claim or dispute that may arise in relation to the validity, interpretation or compliance with these rules.
